{"id":10400,"date":"2019-09-19T20:39:19","date_gmt":"2019-09-19T20:39:19","guid":{"rendered":"https:\/\/www.basham.com.mx\/ratification-by-mexico-of-the-convention-98-of-the-international-labor-organization-ilo\/"},"modified":"2019-09-19T20:39:19","modified_gmt":"2019-09-19T20:39:19","slug":"ratification-by-mexico-of-the-convention-98-of-the-international-labor-organization-ilo-2","status":"publish","type":"post","link":"https:\/\/basham.com.mx\/en\/ratification-by-mexico-of-the-convention-98-of-the-international-labor-organization-ilo-2\/","title":{"rendered":"RATIFICATION BY MEXICO OF THE CONVENTION 98 OF THE INTERNATIONAL LABOR ORGANIZATION (ILO)."},"content":{"rendered":"<p><strong><u>Ratification by Mexico of the Convention 98 of the International Labor Organization (ILO).<\/u><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>On September 20, 2018, all members of the Senate unanimously ratified the ILO Convention No. 98, adopted in Geneva, Switzerland in 1949, so as to apply the principles of the right to organize and to bargain collectively.<\/p>\n<p>&nbsp;<\/p>\n<p>The Convention protects workers\u2019 right against any acts of anti-union discrimination, in particular, acts having the purpose of making the employment of a worker subject to the condition that he\/she will not join a union or relinquish trade union membership, thereby granting the workers full power and freedom to elect whether to belong to a union.\u00a0 This provision also eliminates the practice of using a \u201cclosed shop clause\u201d in collective agreements.<\/p>\n<p>&nbsp;<\/p>\n<p>Also, the Convention provides that workers\u2019 and employers\u2019 organizations of a particular workplace may not interfere with each other; \u201cinterference\u201d being understood as any action aimed to promote the creation of a workers\u2019 organization dominated by the employer or employers\u2019 organizations that financially support another workers\u2019 organization, so as to place such workers\u2019 organizations under the employers\u2019 control.<\/p>\n<p>&nbsp;<\/p>\n<p>It further contemplates the obligation to create appropriate and efficient bodies to ensure respect of the right to organize, if necessary.<\/p>\n<p>&nbsp;<\/p>\n<p>Non \u2013 active collective bargaining agreements will be impacted once the Convention enters into force, since they will be subject to an active and accessible scheme towards its unionized workers.<\/p>\n<p>&nbsp;<\/p>\n<p>The Convention will become a part of the Mexican legal system twelve months after being ratified with the ILO.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\">SINCERELY<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"294\">Jorge G.
