{"id":13890,"date":"2021-05-31T22:43:09","date_gmt":"2021-05-31T22:43:09","guid":{"rendered":"https:\/\/www.basham.com.mx\/?p=13890"},"modified":"2021-05-31T22:43:09","modified_gmt":"2021-05-31T22:43:09","slug":"la-cofece-inicia-investigacion-de-oficio-para-determinar-si-existen-o-no-condiciones-de-competencia-efectiva-en-la-distribucion-no-vinculada-a-ductos-de-gas-licuado-de-petroleo-a-nivel-nacional","status":"publish","type":"post","link":"https:\/\/basham.com.mx\/en\/the-cofece-initiates-office-investigation-to-determine-if-there-are-no-conditions-of-effective-competition-in-distribution-not-linked-to-petroleum-liquid-gas-pipelines-nationally\/","title":{"rendered":"La COFECE inicia investigaci\u00f3n de oficio para determinar si existen o no condiciones de competencia efectiva en la distribuci\u00f3n no vinculada a ductos de gas licuado de petr\u00f3leo a nivel nacional."},"content":{"rendered":"<p style=\"text-align: right;\">Ciudad de M\u00e9xico, 31 de mayo de 2021.<\/p>\n<p>&nbsp;<\/p>\n<p>La Comisi\u00f3n Federal de Competencia Econ\u00f3mica (COFECE) public\u00f3 hoy el aviso de inicio de la investigaci\u00f3n DC-001-2021 a fin de determinar si existen condiciones de competencia efectiva en la distribuci\u00f3n no vinculada a ductos de Gas Licuado de Petr\u00f3leo (gas LP).<\/p>\n<p>En torno a esta investigaci\u00f3n, la COFECE aclar\u00f3 que el mercado materia de la declaratoria est\u00e1 relacionado con la venta de gas LP mediante recipientes port\u00e1tiles (cilindros) y auto tanques (pipas), que surten a los domicilios y negocios que cuentan con tanques estacionarios. Por tanto, la investigaci\u00f3n excluye la distribuci\u00f3n por medio de ductos.<\/p>\n<p>Asimismo, aclar\u00f3 que: (i) esta investigaci\u00f3n es independiente de las que actualmente se encuentran en tr\u00e1mite ante la COFECE y (ii) que en este procedimiento, de detectarse la ausencia de condiciones de competencia efectiva, la Comisi\u00f3n Reguladora de Energ\u00eda, autoridad reguladora sectorial, podr\u00eda iniciar un proceso de regulaci\u00f3n para establecer contraprestaciones, precios o tarifas en la distribuci\u00f3n de gas LP al consumidor final.<\/p>\n<p>In this investigation, COFECE may request information in writing, as well as summon those who participate or have a relationship with the market to testify. According to the Ley Federal de Competencia Econ\u00f3mica (Federal Antitrust Law), there is an obligation for the economic agents that are requested to cooperate and submit the requested information to COFECE.<\/p>\n<p>The purpose of the publication of this investigation is to provide any economic agent with an interest in the investigation the opportunity to assist and state what it deems appropriate in relation to the investigated market.
