{"id":27549,"date":"2026-06-23T13:19:26","date_gmt":"2026-06-23T19:19:26","guid":{"rendered":"https:\/\/basham.com.mx\/?p=27549"},"modified":"2026-06-23T13:19:27","modified_gmt":"2026-06-23T19:19:27","slug":"conagua-proposes-regularization-scheme-for-expired-concessions-and-measures-to-address-administrative-backlog","status":"publish","type":"post","link":"https:\/\/basham.com.mx\/en\/conagua-proposes-regularization-scheme-for-expired-concessions-and-measures-to-address-administrative-backlog\/","title":{"rendered":"CONAGUA Proposes Regularization Scheme for Expired Concessions and Measures to Address Administrative Backlog"},"content":{"rendered":"<p class=\"has-text-align-right wp-block-paragraph\">June 23rd, 2026<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1774\" height=\"887\" src=\"https:\/\/basham.com.mx\/wp-content\/uploads\/2026\/06\/ChatGPT-Image-23-jun-2026-01_12_42-p.m-1.png\" alt=\"\" class=\"wp-image-27551\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">On June 17, 2026, the draft Agreement establishing actions for the first stage of the regularization of certain concession and assignment titles (the \u201c<strong>Draft Agreement<\/strong>\u201d) was published on the Comprehensive Regulatory Governance Platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Draft Agreement arises from the existence of a significant number of titles for which the corresponding renewal was not timely requested. To address this situation, it proposes a regularization scheme and, in parallel, seeks to reduce the backlog in the notification and registration of pending resolutions by the authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.<strong>Regularization of Titles<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Concession holders whose titles expired between January 01, 2009, and the date on which the Draft Agreement enters into force may apply for the regularization scheme, provided that the corresponding renewal was not timely requested. However, the Draft Agreement limits its application to certain categories of water use and holders:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Eligible uses: titles for domestic, public urban, agricultural, livestock, and aquaculture uses.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Eligible holders:<ul><li>Irrigation Districts and Units, as well as ejidos.<\/li><\/ul><ul><li>States and municipalities that provide water supply services.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>Individuals holding volumes equal to or less than one million cubic meters per year.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, titles for industrial use and those held by legal entities are excluded from this first stage of the regularization program.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. <strong>Improvement of Administrative Management<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, the Water Authority has accumulated a significant backlog in the processing, notification, and registration of various administrative proceedings and acts, as a result of operational and budgetary constraints. To address this situation, the Draft Agreement establishes extraordinary mechanisms for:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The notification of resolutions issued in connection with applications filed before December 12, 2025, that have not yet been notified to the interested parties.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The registration in the National Public Registry of Water Rights of favorable resolutions relating to concession titles that were notified on or after April 1, 2019, but have not yet been duly recorded in the corresponding registry.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. <strong>Relevance of the Draft Agreement<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Draft Agreement creates an opportunity for certain holders of expired concession titles to regularize their legal status, even if they failed to timely request the renewal of their titles. In addition, it seeks to provide legal certainty with respect to resolutions that remain pending notification or registration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. <strong>Next Steps<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Draft Agreement must be published in the Official Gazette of the Federation before it may enter into force. Once published, eligible parties will have a period of 365 calendar days to apply for regularization under the proposed scheme.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, within 30 calendar days following its entry into force, the Water Authority must publish a list of resolutions pending notification.
