COFECE Launches Four Antitrust Investigations Across Key Sectors

  1. COFECE RELEASES THE INITIATION OF AN INVESTIGATION INTO POSSIBLE COLLUSIVE PRACTICES IN THE PUBLIC PROCUREMENT OF INSURANCES.

Last Friday, the Investigative Authority of the Federal Economic Competition Commission (COFECE) released that it launched an investigation under case file number IO-004-2024 concerning possible bid rigging in the national market of public procurement of life, accident, health, property, and pension insurances, as well as related operations in those sectors. The investigation arises from COFECE´s constant intelligence work and monitoring of markets; the investigated conduct may constitute absolute monopolistic practices prohibited under the Article 53 of the Federal Law of Economic Competition (LFCE). At this stage, the economic agents subject to the investigation may apply to COFECE´s leniency program.

  • COFECE RELEASES THE INITIATION OF AN INVESTIGATION INTO POSSIBLE ILLEGAL CONCENTRATION IN THE NATIONAL LIME MARKET AND RELATED PRODUCTS.

The Investigative Authority of COFECE released that it launched an investigation under the case file number IO-005-2024 regarding the possible execution of unlawful concentration in the national market for the production, distribution, and commercialization of lime and related products. These investigations are initiated when there is evidence that a transaction may have anticompetitive effects on the market.

  • COFECE RELEASES THE INITIATION OF AN INVESTIGATION OF RELATIVE MONOPOLISTIC PRACTICES (ABUSE OF DOMINANCE) IN THE MARKET OF «MULTIPLE LISTING SERVICES OF REAL ESTATE AND RELATED SERVICES».

The Investigative Authority of COFECE released that it received a complaint that led to the initiation of an investigation of possible relative monopolistic practices (abuse of dominance) in the market for multiple listing services of real estate and related services. The Law provides for the possibility that during the investigation, the Economic Agents engaging in conduct or acts that could be considered relative monopolistic practices may request exemption or reduction of the amount of fines.

  • COFECE RELEASED THE INITIATION OF AN INVESTIGATION OF ABSOLUTE MONOPOLISTIC PRACTICES IN THE MARKET OF PRODUCTION, COMMERCIALIZATION, AND DISTRIBUTION OF CHEMICAL ADDITIVES FOR CONSTRUCTION MATERIALS IN THE NATIONAL TERRITORY.

COFECE announced the initiation of an investigation of possible absolute monopolistic practices in the market for the production, commercialization, and distribution of chemicals for construction materials in the national territory.

COFECE will analyze whether as a result of these possible illegal agreements between competitors in that market, specifically chemicals that are added to various construction materials such as cement, mortar and concrete, there was increase on prices or a limited access to these goods that are necessary for the construction sector that is key to Mexico’s economic growth. At this stage, the economic agents subject to the investigation may apply to COFECE´s leniency program.
