On March 19, 2020, the Plenary of the Federal Antitrust Commission ("COFECE") issued the Agreement by which it resolved that the deadlines of certain proceedings before the COFECE (the "Agreement") will not run.
By means of such Agreement, COFECE determined that as of March 23 and until April 17, 2020, the deadlines and terms of some procedures processed before COFECE will not run, without this implying the closing of COFECE's offices, which will maintain their regular business hours. Consequently, promotions filed with COFECE between March 23 and April 17, 2020 will be considered as filed on April 20, 2020.
The suspension of deadlines does not apply to merger procedures and opinions or resolutions in the granting of licenses, concessions, permits and other similar procedures, which will continue their ordinary course.
However, the suspension of deadlines applies to the rest of the proceedings conducted under the Federal Antitrust Law, including investigations, trial proceedings, special proceedings and incidents.
The announced measure responds to the need to reduce the risk of spreading the COVID-19 virus and to protect public servants, economic agents, practitioners and visitors.
