Legislative Process.

The Judicial Reform bill (“Reform”) was approved by the Senate of the Republic in the early hours of Wednesday, September 11, 2024. This followed its approval by the Chamber of Deputies last week.

The reform was sent to the State Congresses for their review and, if applicable, approval in accordance with the procedures set out in their legislation. Once 17 States give their favorable vote, it will be considered valid, and its publication in the Official Gazette of the Federation will be ordered.

Significance of the Reform.

One of the most important and significant aspects of the Reform is the implementation of the popular election of judges and Supreme Court Justices, which eliminates the current “judicial career” system that has been in place in Mexico until now.

The reform proposes that these elections be held gradually in 2025 and 2027.

Judicial Strike and Protests.

Due to the reform’s impact not only on public officials but on the entire justice system, the Judiciary has been on strike for the past three weeks.

Despite the suspension of activities, the Federal Judiciary Council issued a memorandum outlining urgent cases that must be addressed, including the following:

a. Sanctions and/or measures involving danger to the life or integrity of individuals,

b. All cases related to violations of the right to health,

c. Cases that may risk the provision of basic services and

d. Any other case that the Judiciary may, at its discretion, consider urgent.

Our firm is closely monitoring the Reform, the temporary functioning of the Judiciary, and its possible return to activities while also analyzing how this will impact individual legal lawsuits.
