Mexico City, January 14th, 2021.
The draft Environmental Standard for Mexico City “PROY-NACDMX-010-AMBT-2019, Technical specifications that compostable and / or reusable single-use plastic bags and products must meet”, hereinafter “PROY-NACDMX-010”, was published in the Official Gazette of Mexico City last January 13th, 2021.
The Environmental Standard for Mexico City NACDMX-010, once approved, will establish:
- The characteristics, technical specifications and test methods that single-use plastic bags and products must meet to be considered compostable, in accordance with the Solid Waste Law of the Federal District (“LRSDF” for its acronym in Spanish) and its Regulations.
- The characteristics, technical specifications and test methods that bags must comply to be considered reusable and recyclable, in accordance with the LRSDF and its Regulations.
- The specifications for the handling of waste bags, compostable single-use plastic products, reusable bags and post-consumer recyclable bags; that must be considered in the development of management plans, in addition to the requirements established by the LRSDF, its Regulations and applicable federal regulations.
- The conformity assessment procedure for the products and processes established in the standard.
The Environmental Standard for Mexico City NACDMX-010 will be mandatory, in Mexico City, for individuals and legal entities, public and private, who market, distribute or deliver compostable, reusable and recyclable plastic bags, as well as compostable single-use plastic products, in accordance with the LRSDF and its Regulations.
Any violation to the provisions established in the Environmental Standard for Mexico City NACDMX-010, will be sanctioned in accordance with the provisions of the Environmental Law for the Protection of Land in the Federal District (now Mexico City), the LRSDF and its Regulations, and any other applicable legal regulations.
The Environmental Standard for Mexico City NACDMX-010 will enter into force within 180 days following its publication in the Official Gazette of Mexico City, prior approval of PROY-NACDMX-010.
PROY-NACDMX-010 will be available for consultation for a 30 calendar day period from its publication, that is, until next February 13th, 2021. Any remark must be submitted, in writing, to the General Office of Impact Assessment and Environmental Regulation of the Ministry of the Environment of Mexico City.
