The Investigative Authority of the Federal Economic Competition Commission initiated an investigation to identify and. If it is the case, determine the probable existence of barriers to competition and free market access, as well as possible essential facilities in the public rail freight transport service market and its related services and rights. The Federal Economic Competition Commission presented the book “La política de Competencia Económica en México: Restrosprectiva, Balances y Retos” [Economic competition policy in Mexico: Retrospective, Balances and Challenges]. This commemorative book presents the opinions and analysis of various actors that allow for a plurality of views on the institutional design of the Commission and the implementation of the competition law. The publication contributes to rethinking the direction in which competition policy should advance for the benefit of the populations, regional development, and productive activities in the country. Cofece notifies a statement of probable responsibility for possible collusion in the non-residential real estate leasing market.

The Federal Economic Competition Commission notifies companies and natural persons with a statement of probable responsibility for allegedly manipulating prices in the market of leasing of non-residential real estate spaces on the national territory. Since the reform proposal must be analyzed and discussed by the Congress of the Union, Cofece believes it is important to consider all the evidence available to determine the institutional design. Therefore, Cofece welcomes the proposed debate, respecting the legislative process and seeking to participate in order to contribute to the public dialogue and strengthen a competition policy that prioritizes improving the quality of life of the population. Cofece identifies possible barriers to competition in retail e-commerce.

the Investigative Authority (IA) of the Cofece preliminarily determined that there are no conditions of effective competition in the retail e-commerce market in Mexico. This market is very important because, since the beginning of the Covid-19 pandemic, more and more consumers use this option to purchase goods or services. According to the IA, these markets are highly concentrated, are characterized by the presence of network effects and the amounts of investment for their development and operation are high, which makes them susceptible to several barriers to entry. The Federal Economic Competition Commission (Cofece or Commission) informs that the approval of the operation originally notified by Mexico Infrastructure Partners FF, S.A.P.I. de C.V. (MIP) and the National Infrastructure Fund (FONADIN) to acquire 13 electric power generation plants from Iberdrola Generación México, S.A. de C.V. and its subsidiaries (Operation) has been subjected to conditions. Compliance with these conditions will ensure that economic competition of the electric generation market is not affected. Read more.
Cofece determines the lack of effective competition conditions in the maritime transport of passengers and roll-on/roll-off cargo in Baja California Sur.

The Board of Cofece determined the absence of effective competition conditions in the
Pichilingue – Mazatlán and Pichilingue – Topolobampo maritime routs. This is due to the fact that there is a high degree of concentration, shipping lines have the ability to set their rates and fares, they may not meet the needs of users, and there are barriers to entry and lack of access to sources of inputs. The Ministry of the Navy is responsible for establishing the tariff regulation for these services. Read more.
Cofece modifies Regulatory Provisions of the Federal Economic Competition Law.

By means of Notice CFCE-033-2024, the Board of the Commission agreed to modify articles 158, 159, 160 and 162 of the Dispositions. These modifications were made with the purpose of reinforcing and clarifying the regulatory framework related to the imposition and lifting of precautionary measures in the proceedings before the Commission. Cofece and Jalisco promote economic competition policy in the state.
March 6, 2024
Through a series of working meetings with representatives of Jalisco’s economic development cabinet, strategic lines of action were jointly defined aimed at implementing best practices and training to align regulatory efforts and public policies in order to promote a business environment in which competition exists on equal terms. A Framework Collaboration Agreement was also signed with the Rector of the University of Guadalajara to raise awareness of the importance of economic competition policy and free competition among the generation in formation. The report presented at Cofece on March 7 was prepared by the Mexican Academy of Cybersecurity and Digital Law and funded by the British Embassy in Mexico. With the report, the Commission seeks to offer strategic recommendations that serve as a basis for the development of a National AI Strategy, recognizing the importance of new technologies such as AI in innovation, economic growth and the generation of new products and services for Mexicans. Cofece promotes competition policy with collaboration agreement with CONCANACO SERVYTUR

Cofece signed a collaboration agreement with the Confederation of National Chambers of Commerce, Services and Tourism, which seeks to strengthen and promote a culture of competition among its member chambers and companies. This collaboration agreement creates an Economic Competition Advisory Committee to offer guidance, workshops, conferences and discussion tables so that small, medium and large businessmen can detect and prevent anti-competitive practices.
Cofece proposes key actions to enable Mexicans to buy better quality beef at lower prices

Cofece published a study in which it analyzed the conditions of competition and free competition in the beef production, distribution and marketing markets. Through this study, the Commission proposes a series of key actions to facilitate the participation of more beef producers, distributors and marketers, in order to increase supply, improve price and quality for the benefit of consumers. Representatives of the Cofece participated in the International Competition Network’s Technologist Forum along with more than 20 international competition and consumer protection authorities.
