COFECE INITIATES INVESTIGATION FOR THE POSSIBLE COMMISSION OF RELATIVE MONOPOLISTIC PRACTICES IN THE MARKET FOR THE SUPPLY AND WHOLESALE DISTRIBUTION OF CONSUMER GOODS, THEIR RETAIL COMMERCIALIZATION AND RELATED SERVICES.

Mexico City, November 26, 2020.

 

The Federal Antitrust Commission (COFECE) published today the notice of initiation of the ex officio investigation IO-002-2020 for the possible commission of relative monopolistic practices in the wholesale supply and distribution market of consumer goods, retail marketing of consumer goods and related services.

In connection with this investigation, COFECE explained that it recently published the Competition study in the modern food and beverage retail channel which points out that within the modern channel, large retail chains can impose terms and conditions on their suppliers (such as delaying payments or applying discounts to suppliers), and added that this type of behavior creates uncertainty for small suppliers and transfers to them the risk of not selling the products that the retailer has already purchased, which has a negative impact on their finances.

In this investigation, COFECE may request information in writing, conduct verification visits, as well as summon economic agents that participate or have a relationship with such market to testify. Pursuant to the Federal Antitrust Law, the economic agents that are requested and visited must cooperate and submit the requested information to COFECE.
