La Comisión Federal de Competencia Económica (COFECE) publicó hoy el aviso de inicio de la investigación DC-001-2021 a fin de determinar si existen condiciones de competencia efectiva en la distribución no vinculada a ductos de Gas Licuado de Petróleo (gas LP).
En torno a esta investigación, la COFECE aclaró que el mercado materia de la declaratoria está relacionado con la venta de gas LP mediante recipientes portátiles (cilindros) y auto tanques (pipas), que surten a los domicilios y negocios que cuentan con tanques estacionarios. Por tanto, la investigación excluye la distribución por medio de ductos.
Asimismo, aclaró que: (i) esta investigación es independiente de las que actualmente se encuentran en trámite ante la COFECE y (ii) que en este procedimiento, de detectarse la ausencia de condiciones de competencia efectiva, la Comisión Reguladora de Energía, autoridad reguladora sectorial, podría iniciar un proceso de regulación para establecer contraprestaciones, precios o tarifas en la distribución de gas LP al consumidor final.
In this investigation, COFECE may request information in writing, as well as summon those who participate or have a relationship with the market to testify. According to the Ley Federal de Competencia Económica (Federal Antitrust Law), there is an obligation for the economic agents that are requested to cooperate and submit the requested information to COFECE.
The purpose of the publication of this investigation is to provide any economic agent with an interest in the investigation the opportunity to assist and state what it deems appropriate in relation to the investigated market. Therefore, any person or company that considers that it has an interest in the investigated market will have the opportunity to express it before COFECE.
