Mexico City, October 22nd, 2020
The Investigation Authority of the Federal Telecommunications Institute (the “Investigation Authority”) has published an initial notice of investigation with respect to online search engine services, social networks, mobile operating systems, cloud computing services and related services to determine the possible existence of barriers to competition and free market access or essential inputs that may generate anticompetitive effects.
This investigation will be carried out pursuant to Article 94 of the Federal Economic Competition Law to determine whether it is necessary to impose coercive measures to correct structural problems in the abovementioned markets. In this case, the measures could consist of an order aimed at a dominant market participant to eliminate a barrier that unduly affects free market access and competition or a declaration of the existence of essential supplies which would allow the issuance of guidelines to regulate modes of access, prices or rates, technical and/or quality requirements to said supplies, as well as their respective implementation schedule on a case-by-case basis, among other measures.
The Investigation Authority may request documents and information, issue subpoenas, interview individuals related to the case, conduct on-site inspections and order any other measures deemed necessary to pursue its investigation.
The investigation may last up to 120 business days starting today, a term which may be extended for an equal period up to two times.
