Gradual implementation of the 40-hour workweek has been announced

Mexico City, May 5th 2025

On May 1, 2025, in commemoration of The International Labor Day, Marath Bolaños, head of the Ministry of Labor and Social Welfare (“Labor Ministry”), announced that, by instructions of President Claudia Sheinbaum Pardo, Mexico will implement the 40-hour workweek in a progressive manner.

Although the specific process for this gradual transition has not yet been defined, the head of the Labor Ministry indicated that the goal is to reach a 40-hour workweek by January 2030. It is estimated that the reduction could occur at a rate of two hours per year starting in 2027.

In addition, President Claudia Sheinbaum Pardo announced the start of working sessions in June and July of this year with employer chambers, workers, union leaders, and specialists, aiming for an open dialogue among stakeholders to ensure an appropriate implementation of the reform. It is expected that the consensus-based reform will be discussed, voted on, and approved during the second half of this year, in the last legislative session.

It is anticipated that these working sessions will not only focus on the constitutional reform but also discuss in detail aspects outlined in the Federal Labor Law (e.g., possible standardization of day, night, and mixed shifts; prioritizing Saturday as a rest day; changes in rules regarding overtime, etc.).

It is essential that, when approved, companies already have an implementation plan to mitigate potential impacts on productivity and personnel hiring. In cases where workers need to work beyond the legal limit, the additional costs related to overtime pay and the restrictions outlined in the Federal Labor Law and anti-exploitation provisions must be considered.
