Mexico City, February 4th 2025.
President Claudia Sheinbaum presented the content of the secondary laws on energy matters and possible constitutional amendments (the “Amendment”), which will be submitted to the Congress of the Union for discussion and eventual approval. Below are the most relevant aspects of the Amendment:
Law Initiatives.
- Issuance of (i) Law on Energy Planning and Transition, (ii) Law on the State-Owned Enterprise, “Comisión Federal de Electricidad”, (iii) Law on the State-Owned Enterprise, “Petróleos Mexicanos”, (iv) Electricity Sector Law, (v) Hydrocarbons Sector Law, and (vi) Law of the “Comisión Nacional de Energía”.
Transformation of “Petróleos Mexicanos” (PEMEX) and “Comisión Federal de Electricidad” (CFE).
- PEMEX
- Preferential treatment in exploration and extraction assignments and contracts.
- Investment in new technologies for exploration, petrochemical industry and fertilizers.
- CFE
- Investment of $23.4 billion dollars (2024-2030):
- $7.5 billion dollars in transmission and interconnection networks.
- $3.6 billion dollars in distribution, substations and transformers.
- $12.3 billion dollars in generation of an additional 13,024 MW, prioritizing clean energy.
Creation of the “Comisión Nacional de Energía” (CNE).
- Assumes the roles of the “Comisión Reguladora de Energía” and “Comisión Nacional de Hidrocarburos”.
- Permits in hydrocarbons and electricity.
- Planning, regulation and supervision of the production and distribution of hydrocarbons and petroleum products.
Public-Private Partnership Framework in Hydrocarbon Exploration and Extraction.
- Mixed contracts between PEMEX and private investors.
Private Participation Schemes in Electricity Generation and Self-Consumption.
- Distributed generation: Exempt from permits.
- Isolated self-consumption: Installation from 0.7 to 20 MW through a simplified process.
- Interconnected self-consumption: Exclusive sale of surplus energy to the CFE.
- Long-term production contracts: Exclusive sale of energy to CFE.
- Mixed investment generation: CFE will produce 54% of the electricity, while the private sector will generate the remaining 46%.
- Unrestricted electricity generator: Free sale of energy and associated products in the wholesale electricity market.
