Mexico City, May 06th, 2021.
The Federal Economic Competition Commission (FECC) announced today that it has opened an investigation under file no. DE-027-2020 into potential abuse of dominance practices in the generation, wholesale marketing and supply of electricity and related products, services and activities in Mexico.
The FECC explained that this case is separate from the constitutional controversy that COFECE filed against the Decree that reforms several provisions of the Electric Industry Law. On the other hand, this investigation will focus on determining whether one or more dominant market participants violated the Federal Economic Competition Law (FECL).
The FECC may require economic agents in the relevant market to provide documents, information or conduct on-site inspections. In such cases, the FECL may compel these entities to cooperate with the FECC and provide it with the requested information.
On the other hand, this announcement aims to provide interested economic agents with the opportunity to cooperate and provide information deemed appropriate with relation to the investigated conduct or circumstances which may be in violation of the FECL. Therefore, any individual or company involved in the relevant market that considers that it may have been affected has the opportunity to contribute to the FECC’s investigation.
