AMENDMENT TO THE AMPARO LAW PUBLISHED ON MARCH 13, 2025

On March 13, 2025, the Decree amending various provisions of the Amparo Law was published in the Federal Official Gazette.

The amendments entered into force on March 14, 2025, except for those related to the operation of the Supreme Court of Justice of the Nation, which will take effect once the Court’s current composition changes.

The purpose of the amendments is to make the legal framework of the amparo proceeding more inclusive, as well as to align its content with other current legal provisions and the Judicial Reform.

Among the most relevant changes are the following:

  • The language of the Amparo Law has been updated to ensure inclusive terminology.
  • All references to the Chambers of the Supreme Court of Justice of the Nation have been removed.
  • Six votes from the Justices of the Supreme Court are now required for a criterion to be considered a binding precedent.
  • All references to the “Federal Judiciary Council” have been replaced by “Judicial Administration Body” and “Judicial Disciplinary Court.”
  • It has been reaffirmed that, in amparo proceedings where the unconstitutionality of general rules is declared, rulings shall not produce general effects.
  • Section III of Article 61 of the Amparo Law has been amended to establish that amparo proceedings are inadmissible against acts issued by the new Judicial Administration Body and the Judicial Disciplinary Court.
  • The National Code of Civil and Family Procedure is now incorporated as supplementary legislation.
  • All references to the minimum wage have been replaced by the Unit of Measurement and Update.
